Welcome to EMSnova (“we”, “us”, or “our”). By accessing or using our website https://emsnova.shop, you agree to be bound by these Terms of Service.

1. Products & Information Disclaimer

Our EMS devices are intended for body contouring and muscle stimulation purposes. Individual results vary and are not guaranteed. We make no representations or warranties, express or implied, regarding the effectiveness, results, or suitability of our products for any specific individual or condition.

Product descriptions, specifications, and images are for informational purposes only. We reserve the right to modify product specifications without prior notice.

2. Orders & Acceptance

All orders are subject to our acceptance. We reserve the right to refuse, cancel, or limit any order for any reason, including but not limited to: product availability, pricing errors, suspected fraud, or shipping restrictions.

If we cancel an order after payment is processed, we will issue a refund. Our liability in such cases is limited to the amount paid.

3. Pricing & Payment

All prices are in U.S. Dollars (USD) and do not include taxes, shipping, or customs duties unless stated otherwise.

We accept payments through third-party gateways (PayPal, Stripe). By placing an order, you authorize us to charge your selected payment method. We are not responsible for payment gateway errors, fees, or security breaches beyond our control.

For wholesale/bulk orders, quotes are valid for 30 days. Deposits for custom orders are non-refundable.

4. Shipping & Delivery

Shipping times and costs are estimates only. We are not responsible for:

• Carrier delays, lost packages, or damage during transit
• Customs clearance delays or import restrictions
• Incorrect shipping addresses provided by you
• Any consequential damages resulting from shipping delays

Risk of loss passes to you when the carrier takes possession of the products.

5. Returns & Refunds

Please refer to our Refund Policy. Returns may be subject to applicable restocking fees as outlined in our Refund Policy. Refunds, if issued, are limited to the product purchase price excluding shipping and handling fees.

Custom orders, wholesale orders, and used devices are final sale and non-refundable.

6. AS-IS Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• Our products will meet your specific requirements or expectations
• Results will be achieved or maintained
• Our website will be uninterrupted, error-free, or secure

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMSNOVA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR USE OF OUR PRODUCTS OR WEBSITE.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. IF YOU HAVE NOT PAID ANY AMOUNT, OUR TOTAL LIABILITY SHALL BE $100.

8. Indemnification

You agree to indemnify, defend, and hold harmless EMSnova, its owners, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

• Your use of our products or website
• Your violation of these Terms
• Your violation of any third-party rights
• Any claims made by your clients or customers if you use our products commercially

9. User Responsibility & Assumption of Risk

You acknowledge and agree that:

• You are solely responsible for determining whether our products are suitable for your intended use
• You assume all risks associated with using our products, including but not limited to muscle soreness, skin irritation, or other physical effects
• You should consult a physician before using our products, especially if you have any medical conditions
• Pregnant women, individuals with pacemakers, epilepsy, or cancer should not use our products
• We are not responsible for any injuries, side effects, or damages resulting from improper use, failure to consult a physician, or use by individuals with contraindicated medical conditions.

10. Bulk / Wholesale Orders

Wholesale and bulk orders are subject to separate written agreements. Custom configurations (logo, packaging, handle count) are non-refundable once production begins. Deposits for custom orders are non-refundable.

We are not liable for any business losses, including lost revenue or customer claims, arising from the use or resale of our products.

11. No Class Actions

YOU AGREE TO RESOLVE ANY DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING.

12. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, excluding its conflict of law principles.

Any dispute arising from these Terms or your use of our website shall be resolved through binding arbitration administered by the American Arbitration Association (AAA). The arbitration shall take place in Delaware, and the language shall be English. Judgment upon the award may be entered in any court having jurisdiction.

You agree that any arbitration or legal proceeding shall be filed within one (1) year after the claim arose; otherwise, the claim is permanently barred.

13. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, government orders, labor disputes, supply chain disruptions, or carrier issues.

14. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and EMSnova regarding your use of our website and products, superseding any prior agreements.

16. Changes to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use after any changes constitutes acceptance.
